The Australian Institute of Credit Management is seeking feedback from its members about proposals for legislative change in NSW debt recovery laws:

What debt recovery laws would you change in NSW?

The NSW parliament is holding an inquiry into debt recovery in NSW and we would like your feedback on proposals for legislative reforms.

This is a good opportunity for members to broadcast their ideas and grievances to the parliamentary committee because it has some power to commence legislative change. The key issue to remember, however, is that it only deals with NSW laws and therefore federal laws such as unfair preference claims or personal property securities aren’t within the jurisdiction of the NSW parliament.

The submissions are due by 16 May 2014 and our NSW Council will be compiling your comments before considering a final submission to the parliamentary committee. If you are interested in appearing as a witness in the inquiry or participating in another way please contact the NSW Council.

The terms of reference for the inquiry are:
Inquiry into debt recovery in NSW
Terms of reference
That the Committee inquire into, and report on, the debt recovery framework in NSW and in particular:
i. The effectiveness of current legislation and administrative arrangements;
ii. Any barriers to the debt recovery process, and impacts on third parties responding
to debt recovery actions;
 iii. Possible measures to make the debt recovery process more efficient;
iv. Practice in debt recovery in other jurisdictions; and
v. Any other relevant matters.
