  • Declaration of trust

A declaration of trust is a statement of acknowledgment by the holder of a legal or equitable interest in property that their property is being held on trust for another person (the beneficiary) or for certain specified purposes. A declaration of trust is a way to bring a trust into legal being, and is necessary where the owner of the property is also the trustee (not a trust by transfer).
