  • Quantum meruit

    An amount claimed by way of restitution as reasonable recompense for a benefit conferred or work done at the request of another on the grounds that there was an implied promise to pay for it. It allows a contractor to claim for partially completed work done pursuant to a contract which provides for a lump sum payment on completion of the work. The contractor would not receive payment for the work done under the contract because he or she has not fulfilled the condition precedent to payment (ie completion).
